Photo Contest Rules

Eligibility

This contest is open to anyone 18 years of age or older, and is void where prohibited by law.

Entry Period

Photos may be submitted any time from the announcement of the contest until midnight (EST) on May 30, 2010. No photos received after this period will be considered for prizes. Happy Seamstress Pattern Co. reserves the right to change the entry period at any time without notification.

How to Enter

Submit a photo by completing this form. Photos must be no larger than 2MB, and must be in a common file format (.jpg, .gif, or .png only). An actual file must be submitted, not a link to a file hosted on another site. No other method of entry will be accepted.

Copyright and Ownership

By entering the contest, you warrant that the photo you submit is original and your own. You further warrant that your photo does not infringe on the rights of any third party, and does not violate any contracts or agreements made by you or any third party.

By entering, you grant Happy Seamstress Pattern Co. and it’s partners and affiliates the non-exclusive right to use, publish, publicly display, and reproduce your photo for any purpose without payment of compensation. You will retain the right for future use of your submitted photo. You also grant Happy Seamstress Pattern Co. the right to display your name (as entered in the submission form) for any purpose in conjunction with this contest.

Model Release

If your photo includes a recognizable person or people, you must obtain each person’s permission to use his/her photo in the contest. In the case of a minor (anyone under 18 years of age) you must obtain the permission of the minor’s parent or legal guardian. By entering this contest, you warrant and certify that you have obtained such permission.

Judging Criteria

All acceptable entries (as deemed in the sole discretion of Happy Seamstress Pattern Co.) will be displayed in an online gallery. Entries will be rated by visitors to the website. Starting May 31, 2010, Happy Seamstress Pattern Co. (and it’s partners, agents, and/or affiliates) will judge the top 10 photos as voted by the website visitors. The judges will choose their top three favourite entries based on quality of execution of the craft shown, and the creativity of the photograph.

The judgment made by Happy Seamstress Pattern Co. and/or it’s affiliates, partners, and agents is final.

Winner Notification and Prizes

The winner(s) will be notified via the e-mail address provided in the submission form. If an e-mail address provided is not valid, Happy Seamstress Pattern Co. reserves the right to award the prize to the next runner-up.

To claim their prize, the winner must provide Happy Seamstress Pattern Co. with a valid mailing address by replying to the winning notification e-mail no later than fifteen (15) days after the notification e-mail is sent. The winner has the right to not provide their mailing address, but in doing so will result in disqualification and forfeiture of the prize. Happy Seamstress Pattern Co. only requires the winner’s mailing address in order to ship the prize, and will not store or share the winner’s mailing address except as may be necessary to ship the prize.

Prizes must be accepted as-is, and cannot be exchanged for cash value.

This contest is subject to all applicable federal and local laws.

By entering this contest, you warrant that you are eligible to enter the contest according to the applicable laws and regulations of your home country or territory, and of Ontario, Canada.

In the event of a dispute regarding the true identity of the entrant, the entrant will be deemed to be the legal owner of the e-mail account submitted with the photo.

Happy Seamstress Pattern Co., in it’s sole discretion, may cancel the contest at any time, or modify the rules and regulations without notification.

Happy Seamstress Pattern Co. reserves the right to disqualify any entries for any reason, such as failure to comply by contest rules. Happy Seamstress Pattern Co. reserves the right to seek damages up to the fullest extent permitted by the law if you intentionally cause any damage to the Happy Seamstress Pattern Co. website or its servers, cause any other harm or damage, or fail to comply with any laws.

Happy Seamstress Pattern Co. is not responsible for any lost or damaged entries.

By entering this contest, you agree to release Happy Seamstress Pattern Co. and its agents, partners, and affiliates from any claims, legal actions, damages, judgments, or for any losses or injury to earnings, profits, or goodwill, or for any direct, indirect, special, punitive, incidental or consequential damages, including attorney’s fees and court costs, associated with entering this contest, arising out of or relating to this photo contest or your access or lack of access to the Happy Seamstress Pattern Co. web site, or in connection with any prize won or the use or misuse or malfunction of any prize awarded, or any use by Happy Seamstress Pattern Co. of your submitted photo(s). You agree to defend, indemnify, and hold harmless Happy Seamstress Pattern Co. and its agents, partners, and affiliates against and from any and all third party claims, actions, damages, judgments or settlements.
